学位授予标准的正当逻辑与立法构造——以学位授予的非学术标准为中心 被引量:1

The Legitimate Logic and Legislative Structure of the Degree Awarding Standard:Centered on Non-academic Criteria for Degree Awarding

摘要 学位授予标准的正当逻辑重在回应设立学术标准与非学术标准的正当性来源问题,其既是研究学位授予标准应当首先澄清的重要理论议题,也是廓清非学术标准立法构造的重要实践依据。随着学位制度的深入推进与《学位法》的出台,学位授予标准正当逻辑的既有理论的缺陷愈加展露,需要以类型区分的方法重构全新的理论方案。由此,应明确非学术标准的正当逻辑为立法授权,《学位法》第22条也提出高校制定学位授予具体标准的赋权应当止于学术标准,高校并不享有自行增设非学术标准的权限。政治标准、品行标准、道德标准属于非学术标准的法定范畴,未来可以通过出台“学位法实施办法”等规范的形式,廓清不同标准的规范意涵,从而准确把握非学术标准的立法构造。 The legitimate logic of degree awarding standards focuses on the legitimate source of academic standards and non-academic standards,which is not only an important theoretical issue that should be clarified first in the study of degree awarding standards,but also an important practical basis for clarifying the legislative structure of non-academic standards.With the deepening of the degree system and the promulgation of the Degree Law,the existing theoretical defects of the legitimate logic of the degree awarding standard are more and more exposed,and a new theoretical scheme needs to be reconstructed by the method of type differentiation.Therefore,it should be made clear that the legitimate logic of non-academic standards is legislative authorization,and Article 22 of the"Degree Law"also proposes that the empowerment of universities to formulate specific standards for degree awarding should stop at academic standards,and universities do not have the right to add non-academic standards on their own.Political standards,conduct standards and moral standards belong to the legal category of non-academic standards.In the future,the normative meanings of different standards can be clarified through the introduction of"Measures for the implementation of the Degree Law"and other normative forms,so as to accurately grasp the legislative structure of non-academic standards.
