摘要
“恢复性司法”是一个在翻译国外文献时新产生的术语,“人民调解”和“刑事和解”与其有密切的关系,从不同角度体现了恢复性司法的内容。我国对恢复性司法的系统介绍和研究开始于2002年,经历了最初引入和初步研究阶段、深入研究和高层重视阶段、立法确认和深入发展阶段。恢复性司法已经成为我国一个热点研究主题,发表了大量研究成果。研究得较为深入的主题包括对于环境犯罪的处理、未成年人犯罪案件的处理、在刑罚执行领域的应用。同时,犯罪侦查机关、检察机关、审判机关和刑罚执行机构都进行了应用恢复性司法的实践。恢复性司法已经具有可靠的制度保障,丰富的实践经验以及广泛共识、文化基础和人民调解基础,因而具有良好的发展前景。
Restorative justice is a term newly created when translating foreign literature,and“peoples mediation”and“criminal reconciliation”are closely related to it,reflecting the content of it from different perspectives.The systematic introduction and research on restorative justice in China started in 2002,which has gone through the stages of initial introduction and preliminary research,in-depth research and high-level attention,and legislative confirmation and in-depth development.Restorative justice has become a hot research topic in China,and a large number of research results have been published.The more in-depth research topics include the handling of environmental crimes,the handling of juvenile delinquency cases,and applications in the field of corrections.At the same time,criminal investigation agencies,procuratorial agencies,judicial agencies and penalty enforcement agencies have widely applied restorative justice.Restorative justice already has a reliable system guarantee,rich practical experience,broad consensus,cultural foundation and peoples mediation foundation,so it has a good development prospect.
