摘要
法学教学的层次性决定了本科“民法学”课程的教学目标在于实践能力的培养,故课程的组织与方法应当受到上述目的性的约束。由于实现教学目标的条件存在利弊并存的特征,故扬长避短遂成为实现教学目的的必然选择。在上述教学目标的约束下,课程的教学内容,应以“案例分析所需知识之储备”为原则进行取舍;课程的教学方法,则需妥善处理记忆与理解、具体与抽象、知识与应用及输入与输出等方面的关系。
Due to different teaching objectives of legal education and the teaching objective of the undergraduate“science of civil law”course is the cultivation of practical ability,so the organization and method of the course should be constrained by the above objective.Since the conditions for realizing the teaching objective are characterized by the coexistence of advantages and disadvantages,it becomes the inevitable choice for realizing the teaching objectives to promote the advantages and avoid the disadvantages.Under the constraints of the above teaching objective,the teaching content of the course should be selected according to the principle of“the reserve of knowledge required for case analysis”,and the teaching method of the course should properly deal with the relationship between memorization and understanding,concrete thing and abstract thing,knowledge and application,as well as input and output.
