Competency-Based Approach:A New Paradigm for Legal Education Assessment

摘要 我国的法学教学评估体系自20世纪末期以来经历了重要的变革与发展。随着“以能力为导向”的教育理念的提出,法学教学评估开始向更为综合、多元和科学的方向发展,法学教学评估的重点转向了教学质量的系统性评价。我国法学教学标准经历了从传统教学质量评估向以能力评估为核心的转变。当前的评估体系仍然存在评估促进作用未得到充分发挥、评估指标和标准设置与素质教育要求不相符、忽视学校自我评估和自主参与重要性、评估工作规范性不足等问题。以能力为导向的法学教学评估新范式的核心要素包括学生能力的培养、教学质量的提升以及评价方式的多样性。能力导向法学教学评估的关键能力涵盖法律思维能力、理解及适用法律能力、法律沟通与协作能力、开展法学研究能力、法律伦理与职业素养。建立以能力为导向的法学教学评估新范式,需要从评估标准、评估方式和评估结果的公开三个维度入手,通过制定科学合理的标准制定、优化单一性的评估方式以及公开全过程评估结果,来确保评估工作的有效性、公正性和透明性。 Since the late 20th century,China’s legal education assessment system has undergone significant transformation and development.With the introduction of the"competency-based"educational philosophy,legal education assessment has evolved towards a more comprehensive,diversified,and scientific approach,with a focus on systematic evaluation of teaching quality.The standards for legal education in China have shifted from traditional quality assessment to competency-centered evaluation.However,current assessment systems still face challenges,such as underutilization of the evaluative function,misalignment between evaluation criteria and standards with the demands of quality education,neglect of self-assessment and the importance of autonomous participation by schools,and insufficient standardization of the evaluation process.The core elements of the competency-based legal education assessment paradigm include the cultivation of students'competencies,enhancement of teaching quality,and diversity in evaluation methods.Key competencies assessed in competency-oriented legal education include legal thinking,understanding and application of the law,legal communication and collaboration skills,legal research abilities,and legal ethics and professional quality.To establish a new competency-based assessment paradigm,it is necessary to focus on three dimensions:assessment standards,evaluation methods,and the disclosure of assessment results.By developing scientifically sound standards,optimizing evaluation methods,and ensuring transparency of the assessment process,the effectiveness,fairness,and transparency of the evaluation system can be ensured.
