摘要
《红楼梦》文本对“玫瑰露与茯苓霜案”的调解过程展开叙述,以功能性视角阐述女性引导调解实践的行为线索,诠释了女性主体性思想特征及其意识表现。案件系列情节涉及复杂的宗族政治、人情往来和社会结构,在历时性和空间性的描述中展现出女性群体在司法领域中行为类型和主体性意识投射。在解决某个法律问题时,展现出基于“情理”和“礼法”之下的“和谐善治”争议解决观。本文通过分析女性主体性意识及其行为逻辑,丰富了和谐规约之中关于法律规则运用和执行意涵,而女性参与治理的行为再次形成增强女性主体性的媒介,促使女性话语向社会生活的公共领域中心功能区转移。该典型案例实质地打破了法律治理领域对女性主体的隔离,构建出实用理性和道德理性支配之下的角色伦理及其伦理效用评价框架,进一步丰富争议化解社会治理经验。
The text of A Dream of Red Mansions narrates the mediation process of the Rose-orris and Lycoperdon Snow case,expounds the behavior clues of women in guiding mediation practice from a functional perspective,and interprets the ideological characteristics and consciousness expression of female subjectivity.The plot of the case includes complex clan politics,human relations and social structure,which shows the behavior types and subjective consciousness projection of female groups in the judicial field through the diachronic and spatial description.In addressing legal issues,the dispute settlement view of“harmonious and benevolent governance”based on“emotive reason”and“etiquette and law”is adopted.Based on the analysis of female subjective consciousness and behavioral logic,this paper enriches the meaning of the enforcement and application of legal rules in the harmonious stipulation.Women’s participation in governance once again serves as a medium to enhance female subjectivity and promote the transfer of female discourse to the central functional area in the public domain of social life.This typical case essentially breaks the isolation of females in the field of legal governance,constructs the evaluation framework of role ethics and its ethical utility under the domination of practical reason and moral reason,and further enriches the experience of social governance in resolving disputes.
