摘要
随着社会管理和公共服务职能的扩张、市辖区向“管政府的政府”转型、属地责任强化,超特大城市街道办的权责配置已无法适应城市治理的现实需要。为缓解超特大城市街道办的权责失衡问题,各地纷纷展开以推动执法权下沉为主线的改革创新。通过对案例城市新修订的街道办组织条例的文本分析和田野调查,可以发现在治理重心下移时代,街道办的权责定位仍然存在“应然”与“实然”的差别:“应然”层面,街道办的权责配置趋于明确、执法权得以强化、履职保障机制逐步优化;“实然”层面,依然存在权力承接困难、经济发展负担沉重、向社区过度摊派工作等新旧问题。究其原因,主要源于街道办编制不足、行政区划设置不合理“、区—街—社区”关系不清。未来优化超特大城市街道办体制的基本方向应是在保持派出机构性质不变的前提下,真正将街道办坐实为一级权责平衡的“准政府”。
As the functions of social management and public services expand,cities are transitioning toward becoming“governing governments”.In this context,and with the strengthening of territorial responsibilities,the power and responsibility configuration of street offices in megacities can no longer meet the real needs of urban governance.To address the power and responsibility imbalance in subdistrict offices in megacities,various regions have initiated reforms and innovations with the main focus on decentralizing enforcement authority.Through a textual analysis of newly revised subdistrict office regulations in megacities and field investigations,it can be observed that in the era of shifting governance focus,there remains a disparity between the“should be”and the“actual”in the power and responsibility positioning of subdistrict offices.On the“should be”side,the power and responsibility configuration of subdistrict offices tends to become more defined,enforcement authority is strengthened,and performance guarantee mechanisms are gradually optimized.However,on the“actual”side,challenges in assuming these powers persist,there is a heavy burden on economic development,and issues like excessive workload on communities continue to exist.The main reasons for these disparities lie in the inadequate staffing of subdistrict offices,unreasonable administrative divisions,and ambiguious relationships between districts,subdistricts,and communities.In the future,the basic direction for optimizing the system of subdistrict offices in megacities should be to maintain the nature of their agencies while truly positioning subdistrict offices as“quasi-governments”with a balanced level of first-tier powers and responsibilities.
