摘要
由于医疗数据应用中不同主体的利益多元化,现有的知情同意和合理处理两种数据保护模式均无法适应医疗数据应用领域广泛收集、汇聚与流通的需求。综合考虑各方面的因素,应当采取积极利用主义,通过权属差异化配置来对多元主体利益进行平衡:明确个人的知情退出权利保障人格权益,给予政府以认证、监管、控制的权力维护公共利益,给予医疗机构以限制性财产权确保其充分发挥数据效用。
Due to the multiple interests of different subjects in health data usage,the existing two data protection models of informed consent and reasonable processing are unable to meet the needs of extensive collection,aggregation and flow of health data utilization fields.Considering all factors,we should adopt positive utilizationism and balance the interests of multiple subjects through differential allocation of ownership:clarifying the individual’s right to informed opt-out to protect personal rights and interests,granting the government the power to authenticate,regulate,and control to safeguard public interests,and assigning restricted property rights to medical institutions to ensure their full utilization of data.
