摘要
随着医疗大数据探索的不断深入,医学数据安全治理问题日益突出,相关的法规条例标准也在不断完善,受到社会公众的广泛关注。本文通过文献研究与内容分析的方法,发现我国现有的医学数据安全治理的法律法规,从时间横向轴而言呈现国家关注度持续上升趋势,由整体框架设计转向具体领域精细化落实;从地域纵向轴来看则以国家层面的法律法规建设为中心,各省遵循国家意志制定相关执行层面的细则,总体上东部地区建设速度领先西部地区。同时,本文也指出我国医学数据安全治理法律法规存在的问题并提出相关见解。
With the deepening of medical big data exploration,the problem of medical data security governance has become increasingly prominent,and relevant regulations and standards are constantly being improved,which has attracted widespread attention from the public.Through the methods of literature research and content analysis,this paper finds that the existing laws and regulations of medical data security governance in China show a trend from extensive management of the overall framework to the detailed implementation of the overall framework,and the national attention continues to rise from the perspective of the time horizontal axis;from the perspective of the vertical axis of the region,the national laws and regulations are the center,and the provinces follow closely to formulate relevant laws and regulations,and the construction speed in the east is faster than that in the west.At the same time,this paper also puts forward relevant opinions on the problems existing in China’s regulations on medical data security governance as a whole.
