摘要
在鉴定意见愈发成为环境民事诉讼重要证据的背景下,各方当事人及法院更加重视在鉴定意见上的举示和采信。在环境民事诉讼鉴定意见的采信过程中所涉及到的举证责任倒置规则的适用、鉴定意见质证、专家辅助人作用发挥以及裁判文书对鉴定意见采信的说理等方面存在一定不足。而对于环境民事诉讼中鉴定意见可采性的完善,需要在明确法院对鉴定意见审查内容的同时,加强对鉴定意见的各方质证以及裁判文书说理和法官心证公开。
Under the background that expert opinions are becoming more and more important evidence in environmental civil litigation,all parties and courts pay more attention to the presentation and acceptance of expert opinions.There are some deficiencies in the application of inversion of burden of proof,cross-examination of expert opinions,the role of expert assistants,and the reasoning of judgment documents on the acceptance of expert opinions.To improve the admissibility of expert opinions in environmental civil litigation,it is necessary to clarify the contents of the court’s examination of expert opinions,at the same time,strengthen the cross-examination of expert opinions by all parties,and make the judgment documents reasoned and the judges’evaluation open.
