摘要
推进产权制度改革是推进市场化改革的有效路径。矿产资源作为重要的自然资源之一,要按照自然资源产权制度改革的要求,丰富使用权权能以及划定各项权利的边界。本文分析了矿业权的产权要素结构,在探讨矿业权管理现实问题与理论问题基础上,提出建立委托代理体系行使矿产资源资产所有权制度;优化权益在不同产权主体间的分配关系;扩大使用权的出让、转让、出租、担保、入股等权能;建立市场化交易机制,推进合同制管理的意见建议。
Promoting the reform of property rights system is an effective way to promote market-oriented reform.Only when property rights are clear can market elements flow fully.According to the requirements of the natural resources property rights system reform,enrich the right to use rights and delineate the boundaries of rights.This article analyzes the structure of property rights elements of mining rights.This article explores the practical and theoretical issues of mining rights management.The article puts forward opinions and suggestions on establishing an entrusted agency system,optimizing the distribution of rights and interests,expanding the use rights and capabilities,and promoting contract management.
