摘要
我国法院内设机构的行政化运作与扩张性配置严重干扰了审判权的独立行使,虽经顶层设计的强力推动,内设机构改革的实际动作仍较为有限,距离此项改革的预期目标还有不小的差距。长期以来,我国法院内设机构为科层制的运作模式,导致了审判独立困难、审判质效消减、审判力量分散等不良后果。当前,基层法院内设机构数量明显减少,改革的初级目标基本完成,但因行政化倾向延续、不良绩效考核导向以及内设机构改革与他项改革的断裂等内在缘由,制约了改革的纵深推进。未来,应当从业务决策扁平化、办案主体职业化、人员管理专业化三个维度重新定位法院内设机构设置,理顺优化三类内设机构的职能,构建与机构扁平化相适应的配套机制,同时妥善解决人员分流安置、放权与监督平衡等现实问题。
The administrative operation and expansionary disposition of court interior setup in our country have seriously interfered with the independent exercise of judicial power.Despite the strong promotion of the top-level design,the actual action of court interior setup reform is still limited and not yet achieves the desired objectives of this reform.There has been a long-standing bureaucratic mode of operation in China’s courts,which leads to the difficulties of trial independence,the reduction of the quality of trials,the dispersion of the trial force and other adverse consequences.At present,there has been a significant reduction in the number of interior setup of basic-level courts,and the primary goal of the reform has basically been achieved.However,due to the inherent reasons such as the continuation of administrative tendency,the poor orientation of performance appraisal,and the isolation between the reform of interior setup and other reforms,it restricts the deepening of the reform.In the future,it is necessary to relocate the establishment of court interior setup from three dimensions,the flattening of business decision making,the professionalization of case trial subjects,and the specialization of personnel management,so as to rationalize and optimize the functions of court interior setup,to set up a supporting mechanism adapted to the flattening of court interior setup,and at the same time to properly solve the practical problems of personnel distribution and placement,to achieve the balance of delegating power and supervision.
