摘要
监察管辖具有与监察体制改革相适应的生成逻辑。在实践中,监察管辖出现了管辖范围泛化、管辖能力不足、管辖衔接错位等问题,反映了在监察体制改革过程中形成的监察优先主义存在的法治隐忧。为防止监察优先主义向监察中心主义的转化,应当确立依法监察、程序协同、程序谦抑、职责区分、权利保障等原则,修正监察优先主义,并以此为导向,合理收缩监察机关的管辖罪名,建立职务违法犯罪的区分管辖模式,确立管辖权转移的具体规则,明确分案管辖的例外规则,严格并案管辖的适用条件,推动监察管辖制度的体系化完善。
The supervisory jurisdiction has come into being in line with the logic of supervisory system reform. In practice,there are some problems in supervision jurisdiction,including the generalization of jurisdiction scope,the insufficiency of jurisdiction capacity and the dislocation of jurisdiction connection,which reflect the hidden worries over rule of law caused by the Supervision Priority Doctrine formed in the process of supervision system reform. In order to prevent the transformation from the priority of supervision to the centralism of supervision,we should establish such principles as supervision according to law,procedure coordination,procedure modesty and restraint,duty division,and rights protection. Guided by the revised Supervision Priority Doctrine,we should reasonably shrink the jurisdiction charge of the supervisory organs;establish the differentiated jurisdiction mode for the duty-related crimes;establish the specific rules of jurisdiction transfer;clarify the exception rules governing the case division jurisdiction;strictly apply the conditions of the case combination jurisdiction;and promote the systematic improvement of the supervisory jurisdiction system.
