摘要
法治社会建设的提出反映了我国改革开放以来确立的政治型法治向社会型法治的有益扩展。法治社会建设需要多元规范,除国家制定法外,其他形式的规范如软法、民间法、公共政策、党内法规和民事协议等的作用也不可忽视。在研究法治社会之“规范”时应秉持一种结构化思维,即以一种整体的、系统的而非部分的、孤立的视角去思考和分析法治社会建设中的规范问题。对于多元规范的结构化审视存在静态和动态两个基本维度。静态分析以角色-规范-责任为基本框架,聚焦于多元规范内部结构、连带关系及其作用机理的研究,而动态分析则以意识-规则-实践为基本框架,关注多元规范的实际运行机制与实施效果。要想最大化发挥多元规范在法治社会建设中的“规范合力”,需要优化多元规范的组合,使其保持一种协调有序、有机衔接的动态均衡。法治社会建设需要社会主体具备公共理性,在多元规范动态均衡中实现法治社会建设的最终目标。
The raising of legal society construction reflects the beneficial extension from political model of rule of law to social model of rule of law. The construction of legal society needs multiple norms. Besides state law, the function of other norms also could not be neglected, such as soft law, folk law, public policy and civil agreement, etc. We should insist a structured thought when researching the norm of the legal society. That is to say, we should think and analyze the questions about norms though a holistic and systematic thought rather than a partial or isolated thought. There are two dimensionalities to analyze the multiple norms. The static analysis takes role, norm and responsibility as its basic frame, and focus on the research about the internal construction, incidental relationship and action mechanism of multiple norms, while the dynamic analysis takes mind, rule and practice as its basic frame and concern about the actual operating mechanism and implementation effect. It is necessary to optimize the assembly of multiple norms and make them keep a coordinated and orderly, organic linked dynamic equilibrium in order to maximize the joint force of the norms in the process of legal society construction. The social subjects should have the public reason so as to realize the final goal of the legal society construction.
