摘要
通过对8省(自治区)12县(市、区) 614份农民专业合作社问卷、98份市场监管部门问卷的初步统计,以及与12县(市、区)市场监管部门座谈、30余家农民专业合作社的访谈发现,各地都不同程度地存在空壳农民专业合作社问题。空壳社的形成原因主要是为了套取国家项目资金、获得税收优惠、响应上级政府要求和"随大溜",还有少数是因经营不善或产业政策调整而被迫停业后没有及时退出。农民专业合作社法人注销制度要求繁琐,亦客观上抬高了空壳社的退出门槛。空壳社损害了农民专业合作社整体社会声誉,影响到了政策效率,增加了行政部门的监管成本和被寻租风险。应强化《农民专业合作社法》的普法力度,改进现行政府考核机制,完善农民专业合作社扶持政策,同时落实新修订的《农民专业合作社法》,依法清退空壳社。
Through the preliminary statistics of 614 questionnaires of farmers’cooperatives in 12 counties(cities,districts)of 8 provinces(autonomous regions),98 questionnaires of market supervision departments,and discussions with the market supervision departments of 12 counties(cities,districts),interviews with more than 30 farmers’cooperatives show that there exists the problem of empty-shelled farmers’cooperatives in different degrees.The main reason for the formation of empty-shelled farmers’cooperatives is to obtain state project funds,obtain tax incentives,respond to higher government demands and drifted with general trend,and a few are not withdraw in time from business after being forced to close down due to poor management or industrial policy adjustment.Farmers’cooperative legal person cancellation system requirements are very complicate which objectively raised the exit threshold.Empty-shelled farmers’cooperative damages the reputation of farmers’cooperatives,affects the policy efficiency,and increases the supervision cost and rent-seeking risk of administrative departments.We should strengthen the popularization of“the Law on Farmers’Professional Cooperatives”,improve the current government assessment mechanism,perfect the supporting policies for farmers’cooperatives,implement the newly revised“the Law on Farmers’Professional Cooperatives”,and clear the Empty-shelled farmers’cooperative in accordance with the law.
