摘要
多年来,农村宅基地受法律法规所限不能流转、抵押、转让,无法体现所具有的资产属性。中共中央办公厅、国务院办公厅《深化农村改革综合性实施方案》及其配套文件,为试点探索宅基地有偿使用制度和自愿有偿退出机制,农民住房财产权抵押、担保、转让的有效途径,提供了政策支撑。本文就农村宅基地抵押贷款这一新兴的农村宅基地流转方式进行探讨,通过分析当前农村宅基地抵押贷款产生的政策背景、需求分析及其探索实践,对农村宅基地抵押贷款的试点实施,提出相应的探讨和建议。
For many years, the rural homestead is limited by the laws and regulations so that it cannot be circulated, mortgaged, transfered, as well as can not be reflect the asset attributes. General Officeof the CPC Central Committee and General Office of the State Council presented a file named “to deepenrural reform comprehensive implementation plan” and its supporting documents, aimed to provide policysupportment for explorating the paid use system of homestead and exit mechanism, as well as provide theeffective ways for famers' housing mortgaged and guarantees property rights transfer. A new mode of rural land circulation such as the mortgage of house-site in the countryside were discussed in this paper. Proposing the corresponding discussion and suggestions based on the analysis of the current rural land mortgage policy background, the demand analysis and exploration practice, the pilot implementation of mortgage of housesitein the countryside.
