摘要
目前,国家相关法律法规禁止开展农村宅基地抵押贷款,其直接后果是:农村集体建设用地大量闲置,附着在其上的农村房屋也无法流转,使农村居民无法行使其完全产权进行融资。在大力提倡农村土地使用权流转和一部分农户举家入住城市的前提下,提出通过农村房屋抵押贷款撬动宅基地流转,扩大农村居民融资渠道。建议通过试点实践逐步解决农村宅基地的现实矛盾与问题,并对试点过程中应注意的问题进行了探讨。
At present,mortgage of homestead is prohibited by laws and regulations on the rural areas,the consequence of the prohibition is a large mount of rural construction land which can not be use efficient,and which also results in the rural housing build can not be transfer either.On the basis of the transferring of agricultural land and the migration of rural people to urban areas,this thesis discusseed some methods of the mortgage and loans of rural house which could promote the transfer of the homestead land,these methods could also create(build) some new financing channels for the rural residents.Furthermore,this thesis tried to offering some solutions to current dilemma and problems which were already existed in reality through a pilot project solve the contradictions and problems existed in reality about rural homestead gradually by the pilot,and the pilot process should pay more attention to prevent new problems occur,and the thesis also discussed some issues which may occur in the process of the pilot project.
