摘要
在现代社会中,社会救助需在尊重自身制度规律前提下更好凸显人性尊严与权利保护。对此,公众参与不仅发挥着改进社会救助机制、提升制度运行效能与规范性的工具功能,还起着更重要、更根本的维护公民权利、克服耻辱效应的价值功能,兼有理论指向的必要性和现实意义的紧迫性。本文在从制度文本、参与主体形态、参与主要领域三方面梳理我国社会救助公众参与现状的基础上,深挖其政策治理模式的属性及导致的问题,进而本着"依法治理"模式,就改造理念、关键举措等方面提出制度完善的思考建议。
In modern society, social assistance schemes and their implementation should highlight human dignity and protection of rights. In this regard, public participation not only plays a key role in improving the system by enhancing its efficiency and regulatory framework, but also safeguarding civil rights and removing the stigma attached to social assistance. On the basis of a review of China＇s public participation in social assistance, this paper explores the nature of ＂rule of policy＂ and some problems it leads to. It proposes to follow a ＂rule of law＂ approach and puts forward recommendations, including new values and key measures, for improving the system.
