摘要
在监察体制改革的过程中,要处理好《监察法(草案)》与其他法的协调问题。在与《宪法》的协调中,应先修改《宪法》为监察委员会的设立提供宪法依据;《监察法(草案)》对监察委员会调查权、留置权、辩护权的规定应与《刑事诉讼法》中的相关规定保持协调,处理好与《刑法》和《中华人民共和国监察委员会组织法》的关系。
In the process of supervisory system reform,the coordination of the Supervision Law（ Draft） with other laws should be properly dealt with.The Constitution should be modified to provide constitutional basis for the establishment of the Supervisory Committee. The stipulation of Supervisory Committee ＇s investigative power,lien and defense right in the Supervision Law（ Draft） should be coordinated with the relevant provisions of the Code of Criminal Procedure. In addition,we should also deal with the relationship among the Criminal Law and the Organization Law of the Supervisory Committee.
