摘要
公共行政改革的效能革新目标,在法治范围内更好地促进了行政任务的实现,成为勾勒行政组织法理论的主线。而行政组织法学的分析框架,除应修正过去涉及的行政组织类型、中央与地方分权、行政机关编制、公务员法等传统内容外,更应考虑纳入外部竞争机制、整体运作模式、财政自主权、工作人员激励机制、任务、权限、责任三位一体的结构与监督等相关要素。行政组织法的改革,蕴含着行政法基础理论变革的新契机。
The effectiveness revolution, which is the goal of public administration reform, accelerates the implement of administrative tasks under the rule of law and becomes the main line of the theory of administrative organic law. In the analysis framework of administrative organic law, some traditional contents which were referred to in the past should be amended, such as the types of administrative organizations, separation of power between the central and local governments, the establishment of administrative organs, civil servant law and so on. Besides, more attentions should be paid to the adoption of some relevant systems, including the system of external competition, the unitary operation model, financial autonomy, the incentive mechanism of the staff, the triune structure of tasks, authority and liability, the supervision and so on. It is a chance to innovate upon the basic theory of administrative law through the reform of administrative organic law.
