摘要
农民集体经济组织成员权属于《侵权责任法》的保护对象,在成员权被侵害时,成员应有权以自己的名义直接提起诉讼,要求侵害人承担侵权责任。在集体经济组织管理人员、村民委员会负责人或第三人侵害农村集体经济组织权益、侵害农民集体权益,而集体经济组织怠于起诉时,应允许集体经济组织成员以自己的名义提起派生诉讼,以直接维护集体权益、间接维护成员自身权益。
Farmers＇membership of the collective economic organizations belongs to the protected objects by Tort Liability Law. The members are entitled to lodge a complaint in their own names againsit the infringers, who are expected to take on the tort liability for infringement of their membership. To directly maintain their collective rights and interests and indirectly maintain their own rights and in te re sts, the members of the collective economic organizations are allowed to lodge a derivative suit in their own names against the managers of the collective economic organizations, the principals of villagers committee or the third p a r ty , who infringe the rights and interests of rural collective economic organizations and the farmers collective economic organizations in the case of the collective economic organizations＇ slackness in handling the suits.
