摘要
权力运行中都有异化的倾向,其机理在于权力主体与权力运行主体的分离以及权力的支配性、工具性等自然属性。构建规范权力运行的法律机制是遏制权力异化的关键所在,其基本路径在于界定权力边界、明确权力内容、设置运行程序、公开运行过程、严格责任落实。
All the power in operation has a tendency of dissimilation ; the reason is the separation between the body of the power and the subject of the power in operation, as well as the natural property of the power, such as its domination and instrumentality. T he key point of restricting the power＇s dissimilation is to set up a legal mechanism which normalizes the power＇s operation. T he fundamental path is to define the power＇s boundary, to make sure its contents, to set up an operational procedure, to open the operational process, and to implement strict liability.
