摘要
互联网平台型产业对不同边的用户提供不同的产品/服务,且不同边的用户之间存在依赖性,因此,对于如何界定互联网产业的相关产品市场、何为产品、不同边的产品存在什么关系、应以哪一边的产品/服务作为界定平台型产业的产品市场,这些问题在反垄断法的适用中都至关重要,直接运用传统的相关产品市场界定方法会遭遇挫折,互联网带来的新问题需要运用新思维去逐层厘清并加以应对。在对互联网平台型产业经营特性进行分析的基础上,按照经营者的利润来源市场作为界定相关产品市场的依据,既排除了对基础(免费)产品/服务所构成的"边"的干扰,又为网络经济中不同的平台型产业之间划分出了清晰的界线,并有可能达到准确界定相关产品市场的目的。
On the internet platform,internet companies provide different kinds of products but how to define the relevant product market still remains a disputed question. What's more,the different kinds of user groups are connected,which complicates the definition. What is exactly the proper product that fits the test concerning the market delineation? Are there any connections among these varied kinds of products? Which kind of product is the "product"in antitrust sense? The answers to these questions are significant to help solve the puzzles of market delineation. It is unwise to choose one side market to define randomly. The proposal is that,sources of profit can be used for the definition. Not only can it eliminate the disturbance of the relationship constituted by basic( free) products / services,but also draw a clear line between different platform industries in this economic sector. At last,it can help to define the relevant product market.
