摘要
采矿临时用地补偿标准不统一不利于采矿用地制度改革试点的推进。矿业用地包含土地和矿两种不同属性的要素,其补偿问题具有特殊性。短期采矿用地补偿金的实质是使用地表或地下空间的地租、地上物及环境损坏补偿,具体包括土地补偿费、地上物补偿费、环境破坏和地力下降补偿费。文章提出了各部分的计算方法,结合对广西、山西、鄂尔多斯的临时采矿用地补偿标准的调查研究情况,提出相关建议:短期采矿用地补偿标准可采取企业和农民自主谈判,政府提供指导价的方式,也可由政府制定统一标准执行。
Nowadays, the compensation standards of temporary mining land use are not uniform, which is not conducive for the reform of mining land use system. Mining land contains two different elements which are land and mineral properties respectively, while the compensation issue is unique. Short-term mining land compensation is rent for the surface or underground space, compensation for objects overground and environmental damage in essence, which include the compensation for land use, objects overground, environmental destruction and fertility decline. In our study, we present a calculation method for each part mentioned above, and take the compensation standards of temporary mining land use in Guangxi, Shanxi, Ordos as case study, and promote the relevant recommendations： Enterprises and farmers can take independent negotiations for compensation standards of short-term mining land use, the government can not only provide guide price but also develop the uniform standards.
