摘要
采矿用地制度的核心是采矿用地的产权界定、让渡、使用和定价。当前采矿用地制度存在供地方式单一、产权配置错位、集体土地所有权权益受限和产权未细分等问题。采矿用地改革试点在产权细分和可实施性方面做了很大改进,为采矿用地制度优化提供了宝贵经验。下一步,采矿用地制度应向地权细分、保障矿业权与土地产权正当权益的实现及提高名义产权与实践产权一致度的方向迈进。
Delimitation of property rights,circulation,use and pricing are the kernels of mining land use system.Problems such as single supply pattern of land,dislocation of property rights,limited collective land ownership,un-subdivision of property right exist in the current mining land use system.Great improvement has been achieved in the pilot reform of mining exploitation land in terms of property subdivision and implementation,providing valuable experience for the reform of mining land use system.It should be the next goal for the mining land system to achieve the subdivision of property right and the realization of the legitimate rights and interests of mineral right as well as land property rights and enhance the consistency of property rights in law and practice.
