摘要
最新刊布的《岳麓书院藏秦简(叁)》出现了有关秦商品交换、市场管理和商业纠纷等新材料。岳麓秦简显示,秦不仅商品交易种类丰富、货币经济发达,而且还出现了合伙经商的情况。岳麓秦简还披露了秦"列肆"的新史料,这在一定程度上弥补了传世文献记载之不足。特别值得一提的是,该批简文不但首次出现了秦"亭佐"及其管理职能方面的史料,而且还第一次向世人展示了秦处理商业纠纷的过程,为学界深入探讨秦亭制和法制史问题提供了新的史料依据。
The latest published Qin Bamboo Slips Kept in Yue Lu Academy throw daylight on the commodity exchange, market management, commercial disputes and other new materials. Qin not only had a variety of commodity, developed monetary economy, but alsoappeared to be the existenceof a partnership business. The Qin Bamboo Slips also disclose the new historical Qin ＂Lie Si＂, which make up for the deficiency of the ancient literature to a certain extent. In particular, The Qin Bamboo Slips contain not only the ＂ Ting Zuo＂ and management functions of the historical data, but also the Qin processing business disputesfor the first time in the world, which provides a new datafor the study of ＂Qin Ting＂ system and legal history.
