摘要
从城市规划行政的概念与特征出发 ,阐述了规划行政行为内在的理性冲突 ,并以此分析了规划行政过程中“合法”与“合理”的对立统一 ,指出在市场经济中 ,规划行政的合法性与合理性固然可以统一于某种慎密的制度建构 ,但所谓的理性是难以判断的 ,城市规划行政的理性最终只能表现为行政过程中某种程度的民主妥协。
There are some internal conflicts of the rationality in the planning administration. This paper suggests that these conflicts exhibit as the contradictions between the legitimacy and the justification of the administrative activity. These contradictions, though, can be unified in some institutions. It is difficult to judge the rationality by the planning administration. To some extents, it can only be expressed as the democratic compromise in the process of the administration.
