摘要
当代中国法治发展正处于关键的转型期。重温霍姆斯的《法律的道路》这一经典法学名著,重新审视法律现实主义,及其背后法律与道德、现实主义与形式主义、法教义学与实证研究方法、法理学的当代意义等现实问题,本文尝试在经典著作与现实法律问题之间探寻中国当代法律的道路。
China is at a critical point of transition towards the rule of law. Reviewing Holmes' classical masterpieces The path of the Law,is of great importance to re- examine the legal realism,based on which we can further the research into practical issues,such as law and morality,realism and formalism,legal doctrine and empirical studies as well as the contemporary significance of jurisprudence. The article attempts to find the contemporary path of China's law between the classical masterpieces and practical legal issues.
