摘要
司法职业化的进程带来了司法行为的独断性特征,司法民主是对严格司法职业化所带来的弊端的补救,成为提升司法正当性的迫切需要,因而司法民主与司法职业化之间并不存在本质的对立。新修辞学的诞生正因应了司法民主的需求。法律修辞作为践行司法民主的专业技术手段,致力于提升裁判的可接受性,从司法过程内部增强司法决策过程的民主色彩,使司法的民主价值得以具体落实,实现真正的司法公正。对于司法职业化程度不高又亟待通过司法民主提升司法公信力的中国司法而言,这是一条值得探索的进路。
Professionalization has made the practice of law a highly independent enterprise. Democracy in law is meant as a compensation for the excesses brought about by a severe professionalization of the legal occupation. It also provides an urgently need boost to the legitimacy of the practice of law. Therefore, between democracy in law and the professionalization of the practice of law there is no essential contradiction. The birth of rhetoric in law answers the demand for democracy in law. Legal rhetoric as a specialized skill for practicing democracy in law enhances the acceptability of legal judgments and strengthens the tinge of democracy in the process of legal decision-making within the process of law. As such it reifies democratic values in law and accomplishes legal justice. To China, where the degree of legal professionalism is not strong but the demand for legal credibility through democracy is high, rhetoric in law is worthy oath towards orogress,
