摘要
社区管理模式转型也需要法律制度跟进。社区治理不仅要求治理者的行为要符合法律和国家政策,更要直接回应社区自身发展的需求、维护社区居民的自身利益。社区治理主体多元化,更需要在法律层面上对各种主体在社区治理事务中的地位和关系加以明确化和具体化。对社区公共事务的范围加以明确化和具体化,并建立相应的公共事务治理程序制度,也有利于协调社区治理过程中的各方利益关系。
Legal system should follow up to the transformation of community management mode. The management of community affairs should be not only in compliance with legal rules and demands of the local government, but also in response to the development of community and the interests of community residents. Under the situation of multiple subjects participating, the legal status and relations of them should be made clear and definite in management. It improves to coordinate the interests of all parties that the range of community public affairs should be legally clear and specific, a good working mechanism and relevant legal procedure system should be established.
