析劳务派遣之禁止——兼论《劳动合同法(修正案)》 被引量:1

摘要 《劳动合同法》实施后,劳务派遣非但没有出现立法者原意的边缘化或缩减趋势,反而异常火爆,异化为劳务派遣单位和用工单位合谋降低成本、牟取暴利、损害劳动者合法权益的手段。究其原因,既有立法上的缺陷,也有政府通过大力发展劳务派遣促进就业的不当定位,根本性原因则是我国目前还不存在劳务派遣正常发展的环境。《劳动合同法(修正案)》剑指劳务派遣,试图通过完善立法使劳务派遣回归其作为劳动用工补充形式的定位,把派遣用工数量控制在合理范围内。规制劳务派遣,不仅需要完善的立法,更需要强有力的劳动监察。在法制健全的完全竞争市场条件还远远没有形成的现阶段,暂时禁止劳务派遣,是维护劳动力市场正常运转和保护劳动者权利的现实要求,不是因噎废食,而是两害相比取其轻的明智选择。 After the implementation of Labor Contract Law,the ever-animating phenomenon of labor dispatching has not been changed in the direction of marginalizing or reducing tendency just as the law-makers has intended,it has otherwise acquired unbalanced development and even alienated into the unlawful methods by which the units of both the parties to dispatch and hire the labor have conspired to lower cost,reap fabulous profits and impair lawful rights of workers. The Labor Contract Law(revised) has been made just for the relocation of labor dispatching as the complementary form by perfecting law-making,which has made the number of dispatching labor controlled to a reasonable degree. This law-making act means that the management of labor dispatching needs both perfect law and forceful labor supervision.
