摘要
对于劳务派遣三方主体之间的关系,学术界一直存在争论。本文以为,随着市场经济的发展,当劳动力通过市场进行配置,为了使人尽其才,一个劳动者只能形成一种劳动关系的观念正在被全方位地突破,而一个人存在多重劳动关系恰恰是一种常态。这为我们以双重劳动关系来认识劳务派遣提供了基础。
There have always been diputes on the relationships of three major entities in the labor dispatching. With the development of marketing economy, the common opinion that one employee can only involve in one labor relations has been broken through thoroughly. And multi-labor relations is becoming an ordinary phenomenon. Thus, this is the basis for us to study the labor dispatching.
