摘要
我国劳务派遣陷入超常发展的困境,产生了严重的负面效应。这既有劳务派遣自身制度不完善的原因,也受整体用工体制和社会经济因素的影响。对于如何走出劳务派遣超常发展的困境存在争鸣,继续加强管制和提升用工体制弹性是两种截然不同的代表性观点。在当前,管制是规范劳务派遣必不可少的手段。治理劳务派遣应采取系统化的模式,派遣制度改革与制度外环境培育相结合,控制劳务派遣的"量"与提高"质"相结合,完善立法与加强执法相结合。
It is a serious problem in China that employments in the form of labor dispatching increase in an abnormal rate which leads to negative in- fluences. Many factors contribute to this phenomenon including the shortcomings of labor dispatching legislation, current employment system and social conditions. There are different ideas about how to solve the problem among which strengthening regulation further and increasing flexibility of employment system are two most important suggestions. Regulation is necessary now. To control the over rapid development of labor dispatching, a systematic mode should be adopted. Labor dispatching legislation itself should be improved continuously, and a series of other measures should be taken to form an environ- ment suitable to labor dispatching. The amount should be controlled strictly, and the employment quality of labor dispatching should be improved at the same time. Administration of the law should be attached equal the same importance with legislations.
