摘要
作者对三十多年来出版的一百多部涉及立法语言的著作和中国知网、人大复印资料《法理学·法史学》附录载录的论文、中国行政法学会法律语言研究会以及中国修辞学会下属中国法律语言研究会历届会议论文2000余篇,进行了全面的梳理和归纳研究,分为十一个方面呈现其成就、特色、问题与不足:(一)立法语言的权威性;(二)立法语言的准确性;(三)立法语言的技术;(四)立法语言的模糊性;(五)立法语言的失范和规范;(六)立法的语体;(七)立法语言特点;(八)立法语言的人文;(九)立法语言进程;(十)比较与翻译;(十一)国外法律语言。也可以从中看出当代中国立法语言研究的科学性、体系化、务实性的方向发展的历程。
More than 100 Books and 2000 papers on legislative language in China were analyzed. The achieve-ments, features and problems were discussed in aspects including the authority, accuracy, skill, obscurity, stand-ardization, writing style, characteristics, progress of the legislative language , as well as the humanity in the lan-guage, the comparison and translation of the language and the legislative language in other countries. It can be found that the legislative language study in China shows a scientific, systematic and practical way.
