摘要
商业秘密立法成为世界各国立法的热点问题 ,其发展趋势是 :从判例法到成文法再到专门立法 ;民—行—刑事综合救济 ;区域化、国际一体化等。其发展动因在于财富观念的更新、知识经济的兴起、传统知识产权制度的局限。
The legislation for business secret protection has become a hot issue in the legislation circle across the world. The developing trend is characterized by the progress from case law to statute law further to special legislation, by the civil administrative criminal comprehensive relief and by the localization as well as international integration. The driving force behind the development comes from the wealth concept renovation, the flourishing of knowledge economy and the development of its own theories. The limitations of traditional knowledge property system serve also as one of the reasons.
