摘要
商业秘密作为一种重要的智力成果,具有秘密性、经济性、实用性等特征。这些特征决定了对商业秘密法律保护的特殊性。当前我国已经制定了一系列的法律法规对商业秘密加以保护,但这些法律法规在实际运行过程当中还存在着一些问题,一定程度上影响了对商业秘密的保护效果。针对这样的现实情况,迫切需要对当前的立法加以完善,为保护商业秘密提供完备的法律依据。
As an important intelligence achievement, the business secrets have characteristics of secrets, economy and practicality etc. These characteristics of business secrets have decided the particularity protection of the law to the business secrets. Presently, our country had already made a series of laws and regulations to protect the business secrets. But these laws and regulations also have some problems in the in the implementation process. To some extent, these questions affected the effectiveness of the protection to the business secrets. For this reality, we urgently need to improve the current legislation for the protection of business secrets and provides a complete legal protection for the business secret.
