摘要
任何一种法律制度都预设了特定的主体模型作为其逻辑前提。我国《劳动合同法》在预设主体模型时,无论是对劳动者还是用人单位,均采取单一主体模型,这难免出现因模型的代表性不足导致规则的适用范围过宽,该法确立的诸多制度被基于不同主体的特殊属性被选择性适用的问题。要改变这种现状,必须对《劳动合同法》的主体模型进行重构,根据劳动者所处的不同阶层与所属的不同群体、用人单位的不同规模,对劳动者与用人单位进行类型化区分,进而开展不同的制度设计,即"建立多元主体模型,实施分类规制"。
Any kind of legal system will build a specific subject model as its logical premise.When building the subject model,the Labor Contract Law adopts single subject model for both employers and employees,which is the reason for the lax application scope of the law due to the lack of the representativeness of the model.As a result,the systems based on the law are highly electively applied because of the special qualities of different individuals.In order to change the situation,the subject model of the Labor Contract Law has to be reconstructed,classifying employees and employers according to their different classes,groups and scales,developing different system designs,namely "building the multiple subject model,practicing classified regulation".
