摘要
文章阐述了医疗纠纷人民调解制度的背景情况,并对该制度在我国实施过程中存在的问题进行分析;介绍了德国和日本的具体做法;提出增强医疗纠纷人民调解委员会的公信力的建议:通过评鉴程序认清事实、建立调解基础,依靠医学、法律专家处理纠纷,同时建立听证、专家库等监督制约机制,完善医疗纠纷处置办法和医疗责任保险制度。
