摘要
版权问题已成为古籍整理和开发利用的羁绊。引发古籍整理与开发利用中版权矛盾和利益纠纷的原因包括思想认识偏颇、经济利益驱动、法律依据阙如、行政监管不利、行业自律不够等。文章从古籍整理作品的独创性判断、创作法律关系辨析、抄袭剽窃行为的鉴别、侵权赔偿数额确定等视角阐述了相关版权问题的特殊性,提出完善法律法规、加强行政管理、开展版权实践、研发版权技术等解决之策。
The copyright problems have become obstacles to the collation,development and utilization of ancient books.The conflicts of copyright and interests derive from mistakes in thinking and understanding,impetus of economic profits,lack of legal basis,poor administrative supervision,and poor industry self-regulation,etc.This article addresses the particularity of relevant copyright issues in terms of originality of collation works of Ancient Books,analysis of the legal relation of creation,identification of plagiarism,determination of tort damages amount.Finally,the author puts forward the solutions： improving laws and regulations,strengthening administrative supervision,carrying out copyright practice,doing research on copyright technology and the like.
