摘要
对基于图书馆工作而创作出的作品进行职务作品,或者法人作品的认定具有不同的法律意义。然而,正确区分职务作品与法人作品往往并非易事。图书馆界在就职务作品和法人作品的特征与理论开展探讨的同时,应该注重对范例的分析和研究,从实践中汲取教训,积累经验。图书馆还要采取宣传法律法规、建立和完善制度、引入合同模式、构建激励机制、从事作品价值评估、提高无形资产效益等措施加强对职务作品与法人作品的著作权管理。
Identification of the works made for hire and corporate works in library services has different legal significances. It is difficult to define the works made for hire and corporate works correctly. Libraries should focus on the analysis and research of typical cases, and learn from the practices while study the characteristic and theory about the works made for hire and corporate works. Libraries should also strengthen the copyright management of the works made for hire and corporate works through publicizing laws and regulations, establishing and improving the system, introducing the contract mode, building incentive mechanisms, engaging in work value assessment, improving effectiveness of intangible assets ,etc.
