摘要
立足法律规范的体系性解释,可以看出我国食品安全有奖举报制度具备充分的实证法律依据,相关权威文件只是主事机关对举报权利的具体落实。从举报权行使的成本补偿、风险防范及收益对比上看,政府有必要对举报者施以物质奖励,进而引领社会风尚、节约行政成本、提升监管效益。有奖举报制度的推行能够有效弥补行政执法资源的不足,构建一种公私合作的新型监管模式。在我国食品安全监管形势日益严峻的当下,充分挖掘本土制度资源并加以推广适用已经刻不容缓。
From the perspective of systematically interpreting regulations, China's food safety award reporting system has a sound jurisprudential foundation. Those papers promulgated by relevant departments just implement the right to report From the perspective of the cost and risk of exercising the right, it is necessary for government to reward the reporter so as to guide social climate, save administrative costs and increase supervision efficiency. Award reporting system can make up for the shortage of administrative supervision resources and construct a new public-private-partnerships supervision mode in food safety. It is pressing to fully tap and popularize local system resources against the background of increasing severe situation of China' s food safety control.
