摘要
有奖举报作为一项新型行政执法手段在行政监管领域得到广泛应用的同时伴随着诸多质疑之声,这种扬与抑交织的现状真实反映了行政执法模式变迁过程中的肯定与疑惑。通过对公共管理学上公私合作治理背景的描述、宪法上权利行使所对应国家义务的分析、行政法上行政过程论的推演以及历史传统与现实国情的综述,可以发现有奖举报是对作为公民监督权组成部分的举报权的牵引,有着深厚的理论基础。其在行政执法领域的大量应用,是时代变迁下行政执法方式的创新,代表了一种公私合作治理的新模式,对其作进一步研究确有必要,特别需要注意用法律规制防止其异化。
As a new method for administrative law enforcement, Incentive System on Reporting is widely used in recent years. At the same time, it is under question. This phenomenon is a real portray- al of the affirmation and doubt in the process of the administrative law enforcement pattern evolution. From the description of the background of the public-private partnerships in public management, from the analysis on the state duty and fundamental rights in the constitution, from the deduction of the the- ory of administrative process in the administrative law, and also from the summary of the history and national conditions, we can find Incentive System on Reporting is a pull of the Reporting. It has strong legal basis. The wide use of Incentive System on Reporting is an in the administrative law enforcement field. And it represents a new pattern of public-private partnerships. There should be more researches on it, but we should also pay more attention on how to prevent it from dissimilation under law.
