摘要
商业秘密威胁性侵害是一种虽未发生现实侵权但却对商业秘密构成一种将被必然侵权的威胁,在概念界定、行为表现、法律特征及性质认定等方面都有着显著的特征。对商业秘密威胁性侵害在上述方面的特征化研究,就是希望能认识到其特殊性,并对处于此情况下的商业秘密予以针对性的保护。
The threatened infringement on trade secret refers to a condition in which the trade secret will inevita- bly be infringed although no actual infringement occurs, which has its own significant characters in terms of the definition, threatened manifestation, legal features and nature determination and so on. The study on the characterization of infringement on trade secret is carried out from all these aspects in this paper, which aims to empha- size its particularity and call for the pertinent protection of trade secret under this condition.
