摘要
陪审制是英美法系最为重要的司法制度之一,有着深厚的历史和政治文化基础,它是美国独立运动的精神财富。分权制衡的司法民主功能是陪审制最为重要的功能之一。但从历史演进来看,美国的陪审团和专职法官的权力分工并非一成不变,而是呈现此消彼长的态势。美国陪审团与专职法官之间的权力分工的嬗变历程,对于中国当前的人民陪审制度改革极具借鉴意义。
The jury system is the most important one in American judicial systems, which is established in long history and political culture. The reason that the jury system has existed for more than 200 years in America lies in its several important functions, such as its balance and check func- tion. In judicial practice, the allocation of the power between the jury and the judge is waxing and wa- ning. The history of the development of American jury system has enlightening significance for China ＂s reform of people＇s jury system.
