摘要
社会冲突治理不仅仅是单纯的纠纷解决和矛盾处理活动,更是一个追求"善治"的过程。网络舆情是当前社会冲突治理中的一个重要问题,它的双重面相既有利于社会整合,也可能引发或放大现实的社会冲突。但网络舆情并非社会冲突发生的根源,在当前法制资源相对匮乏和不完善时期,网络舆情倒是社会冲突治理可加利用的一种较好资源。从公民社会角度来看,社会冲突治理对网络舆情的宽容,恰正反映了公权机构与民众之间的良性互动,当然,从社会治理角度而言,对网络舆情适当且适度的引导是其走向法治化不可或缺的要求。
The governance of social conflicts is not only a simple resolution of conflicts and contradictions among persons, but also a process of pursuing a good governance situa- tion. In the governance of social conflicts, internet public opinion is of primary importance, which is beneficial to social integration but may cause or enlarge real social conflicts. But it is not the source of social conflicts, and is an available resource in the governance of social con- flicts due to relatively scarce and imperfect legal resources currently. From the angle of civil society, the tolerance for internet public opinion in the governance of social conflicts exactly reflects a positive interaction between public power agencies and the mass. And from the an- gle of social governance, the appropriate and moderate guidance of internet public opinion is an indispensable requirement for legal governance of internet public opinion.
