摘要
1996年职业教育法修改在即,针对该立法刚性不足,缺乏操作性的问题,从法律规范刚性与柔性关系的一般理论入手,分析我国1996年职业教育法在立法刚性上存在的问题,进而通过性质定位,操作性规定的完善,增加责任条款等方面,加强我国1996年职业教育法的刚性,为刚性执法提供良好立法前提。
Legal norm is the rules of people practicing social action.Its most trait is the stern performent,i.e.the rigidity of norm.The vocational educational law have the problem of lack of illustrate.The rivision of vocational educational law should be perfected from these ways,such as definiting the nature of vocational education to make sure the part of vocational education,strenthening the operation of norm to perfect the content of vocational educational law,enhancing the rigidity of norm to perfect the responsibility articles,perfecting the procedure of calling to account and legal relief articles to provide with good environment of enforcing the law.
