摘要
行政评价旨在通过行政评价原则和具体指标导向来约束行政主体在合法、合理、可操作的范围内行使职权,通过行政评价结果对行政行为进行诊断,配之以适当的奖惩措施,来激发行政主体发挥自身的积极性、主动性和创造性,加强政府自身建设。行政评价可以激发行政主体对自身的违法和不当行为的免疫功能,可以遏制错误、反省不当的行政行为、鼓励正确的行政行为,并通过行政评价实现行政能力的全面提升。
Administrative self-restrain theory is a theory of administrative law which emphasizes the executive power of self-control.The theory functions deriving from administrative body to regulate power operation mainly through administrative discretion,administrative decentralization,internal control,internal administrative practice and administrative evaluation practice mechanism.Administrative evaluation system acts as one of the mechanisms,administrative self-restrain theory practice,aiming at restraining administrative body in the lawful,reasonable,and operable scope of duties and powers through administrative evaluation principles and specific index orient.Combined with appropriate incentives,the administrative evaluation results diagnoses administrative behavior and stimulates the administrative subject to play their own positivity,initiative and creativity.Finally,governmental construction can be strengthened,and a harmonious society and good governance objectives can be realized.
