摘要
举报权滥用主要表现为夸大事实、张冠李戴、捕风捉影、无中生有以及其他程序性滥用。其存在的原因主要是政府活动和司法活动公开性不够,传统社会过于强调对举报的保障以及对举报权滥用界定困难、打击不力。对举报权的滥用予以规制需要推进政治体制改革和司法体制改革的力度,增强政府信息和司法活动的公开透明度;加强法制宣传教育和滥用行为的打击力度。
The abuse of information right are mainly exaggerated,mistaken identity,based on hearsay evidence,fabricated,and other procedural abuse.The main reason for its existence is the openness of government activities and judicial activities is not enough,traditional social set too much emphasis on protection and it is difficulty to define the abuse of information right and combat ineffective.Regulation for the abuse of information right needs to promote political reform and judicial reform,and increase the transparency of government＇s public news and the judicial activities;to strengthen legal education and the crackdown to the abuse.
