摘要
职务犯罪实名举报人遭受打击报复情形的长期存在,导致整个社会实名举报行为的总体萎缩。因此,有必要在确证实名举报制度增量功能的基础上,重新建构起体系化的实名举报人保护制度。为此,在观念层面,须确立权利主义的保护观;在操作层面,应明确举报事项密级,同时通过申请、决定、执行相分离式的保护主体模式,完善对实名举报人的事前、事中和事后保护。另外,除强化人身保护外,还应增加生活援助、精神抚慰等相关内容。
Tile long-term existence of revenge to real-name whistleblowers in the duty crime has withered the report behavior in the whole society. So it is necessary to reestablish real-name whistleblower protection system based on the confirming of the incremental system function. Therefore, in the concept level, we should be from the perspective of constitutional rights, regulate and protect citizen report behavior; In the operation level, we should definite the report item level. Meantime, we should strengthen full protection for the real-name whistleblower, through the separation mode of protection subject of application, decision and execution.
