摘要
立足于立法文本展开整全性研究发现,当前我国农村土地整理法律责任立法相对滞后,存在诸多不足,主要问题有:立法体制不健全,立法语言的使用存在瑕疵,立法内容的界定不清晰。这些不足的存在弱化了农村土地整理监管的执行力与实效,要想消除这些不足并使之完善,就必须健全立法体制、矫正立法语言和厘清立法内容。制定、修改和完善我国农村土地整理法律责任立法是非常必要的,也是可行的。
Based on the legislation text, this paper points out that current legal liability legislation on rural land consolidation is relatively backward in China owing to some problems on the imperfection of legislative system, legislative language and legislative contents. Such problems and shortages have weakened the implementation of supervision in rural land consolidation. Therefore, in order to rescind these shortages and make their perfections, it is quite necessary to perfect the legislative system, correct legislative language and clear the legislative contents. It is also necessary and feasible to make, modify and perfect the legal liability legislation on rural land consolidation in China.
