摘要
在竞争全球化的情势下,知识产权源于罗马法的私权属性如何在现代知识产权国家战略中得以合理应用,成为我国传统产业国际化进程中实现知识产权保护的理论需求。知识产权社会化的立法价值取向,是合理原则指导下利益平衡的结果,体现为兼顾效益的立法宗旨、受到社会利益限制的立法内容,以及战略化的立法趋势。实践中,知识产权私权社会化的发展,能够促进知识产权私权属性在现代竞争中的合理应用,对欠发达国家居多的传统产业尤其应当予以知识产权保护,以期实现全球化的利益平衡。
Under the background of competition globalization, how to duly use the civil right nature of intellectual property （IP） originated from Roman Law has become theoretical requirement of realizing IP strategy in the process of China traditional industry＇s globalization.Legislation value tropism of IP socialization is the result of value balance under rational principle. It mainly reflects in three aspects, legislation aim of considering social benefits, Legislation content of the limitation from social interests and legislation trend of strategy. In practice, with the development of Intellectual Property Civil Right Socialization, its civil fight attribute is applied reasonably under modem competition. Thus, this paper suggests to give more IP protetion to traditional industries in developing countries, by which to realize interests balance around the world. K
